Mischa: "I'm not perfect"

Mischa Barton called Ryan Seacrest's radio show this morning to discuss her DUI arrest last month for the first time. "I got a DUI when I was back in LA," she said the Dec. 27 incident. "I was pulled over. Obviously, I am 100 percent responsible for my actions, and I am really disappointed in myself. I am not perfect, and I don't ever intend to do something that stupid again." The 21-year-old former star of The O.C. acknowledged she doesn't have a valid license: "I usually try not to get behind the wheel. It is tough when people are talking about you all the time," she told Seacrest. "You just have to roll with it. I feel like I've got my head on my shoulders pretty good."

Mischa avoids press

Party-hosting duties for DUI suspect Mischa Barton have been put on ice. Her management team - which has been tirelessly working to control the press since "The O.C." star was busted in LA early Thursday morning for drunken driving and possession of narcotics - pulled her from hosting tonight's opening of Cathouse in Las Vegas. "Mischa can't give interviews on the red carpet or deal with the press right now," said a Vegas source, "so they told her she can't do the event." The club was searching for celebrities available at the last minute but was still looking last night.

Rebecca De Mornay offically charged with DUI

Actress Rebecca De Mornay has been formally charged with DUI after being arrested two months ago. The "John from Cincinnati" star was charged Thursday with two counts stemming from her October arrest -- one for driving under the influence and one for driving with a blood alcohol level above .08 percent, according to news reports. She tested at .09 percent following the arrest. The 48-year-old star of "Risky Business" and "The Hand that Rocks the Cradle" was pulled over in Beverly Hills on Oct. 30 for a traffic violation. Officers smelled alcohol on her breath and gave her a field sobriety test, which she failed. She also failed a breath test, which led to the second count. De Mornay is scheduled to be arraigned on Monday, although she won't necessarily have to be in court.

Mischa Barton was arrested in West Hollywood early Thursday morning, authorities confirm. The former star of The O.C., 21, was pulled over at 2:46 a.m. after her vehicle was seen straddling two lanes of traffic and she failed to signal when making a turn, according to an L.A. County Sheriff Department statement released Thursday. She was arrested for DUI and driving without a valid license. "During Ms. Barton's detention, it was determined that she was an unlicensed driver and was driving while under the influence of an alcoholic beverage," according to police. "Ms. Barton was arrested and transported to West Hollywood Sheriff's station where the booking process was completed without incident." The investigation is ongoing. Shortly after 10 a.m., a West Hollywood deputy said: "Ms. Barton has been released from sheriff's custody after she posted $10,000 bail." Initially, police also said she'd been arrested for possession of illegal narcotics, but no more details were available. Barton is currently scheduled to host the opening of the new Las Vegas restaurant and lounge, CatHouse, over the weekend. A representative for Barton did not immediately return a request for comment.

Lindsay denies drinking before 2005 crash

Lindsay Lohan says she was sober before a 2005 car crash near Beverly Hills. The 21-year-old actress is being sued for negligence over the accident in which her Mercedes-Benz hit a van and injured the driver, Raymundo Ortega. Ortega, a busboy, alleges Lohan had been drinking at The Ivy restaurant before the crash even though she was underage at the time. Ortega is seeking at least $200,000 in damages from Lohan and the restaurant. But in a Dec. 15 declaration, Lohan stated: "I did not consume an alcoholic beverage or any type of medication or drug" either before or during her restaurant visit. A call to Lohan lawyer David Ozeran wasn't immediately returned Wednesday. Lohan's declaration was filed Friday in Superior Court by lawyers for The Ivy along with other documents, including a declaration by the waiter who served Lohan. The server, Adam Novicki, said Lohan didn't order alcohol. Alonzo Howell, a Los Angeles police officer who was providing security for The Ivy that day, also said he didn't see Lohan drinking. Lohan has countersued Ortega, citing a California Highway Patrol report that said he was at fault for the crash because he made an illegal U-turn. Lohan served 84 minutes in jail last month after pleading guilty to misdemeanour drunken driving and cocaine charges unrelated to the 2005 crash.

Kiefer checks in for 48-day jail term

Kiefer Sutherland surrendered to jail Wednesday to begin a 48-day sentence for his DUI arrest. Sutherland, 40, was processed into the jail in Glendale, Calif., a Los Angeles suburb, at 5:46 p.m., according to the LA County Sheriff's Department. "Mr. Sutherland is very polite and humble. He was very cooperative during the booking process," said jail spokesman Officer John Balian. "He will be issued an orange jumpsuit, and will be housed alone in a cell, since he'll be a long-term inmate." Sutherland will be assigned to laundry and kitchen duty, serving breakfast, lunch and dinner to the other inmates. As an inmate worker, he'll be allowed the roam the jail "about 75 percent of the time" – rather than be confined to his cell all day – though the only time he'll be in contact with other inmates is when he's serving food, said Balian. The actor was sentenced in an LA courtroom earlier in the afternoon for the DUI arrest and for violating probation. The 24 star wore a black pinstripe suit and looked contrite before the judge, who spared him from the much harsher LA County facility. Asked if he had any comment, Sutherland smiled and shook his head as he walked away from the courtroom. Judge Stuart M. Rice also sentenced Sutherland to five years probation, and he must complete an 18-month alcohol education program and attend weekly therapy sessions for six months. Sutherland is expected to serve his entire term, the LA City Attorney's Office said in a statement. "Sutherland will be serving the 48 days in the Glendale City Jail, with no early release and no good time/work time credit, so we expect that he will serve the entire 48 days in jail," the statement said. His cell measures 8 by 10 feet, and features a toilet, washbasin and water fountain, according to the jail's website. The facility has 48 cells, with two beds each. He will receive two hot and one cold meals a day. Among the menu items: corn flakes, turkey sandwiches, meatloaf, macaroni and cheese and chicken a la king. He will be allowed visitors between 1 p.m. and 4 p.m. for 15 minutes each. No more than two visits per day are allowed. Sutherland previously released a statement saying, "I'm very disappointed in myself for the poor judgment I exhibited recently, and I'm deeply sorry for the disappointment and distress this has caused my family, friends and co-workers on 24 and at 20th Century Fox. I appreciate the support and concern that has been extended to me these last weeks both personally and professionally."

Kiefer makes early deal in DUI case

Kiefer Sutherland struck a deal in his DUI case today, pleading no contest to a misdemeanor drunk driving charge, according to court documents. His attorney met with city prosecutors ahead of his scheduled arraignment next week. The LA City Attorney's office is recommending to the judge that Sutherland be sentenced to 48 days in jail - 30 days for the DUI conviction and an additional 18 days for violating his probation. The actor will be sentenced on December 21. "I'm very disappointed in myself for the poor judgment I exhibited recently, and I'm deeply sorry for the disappointment and distress this has caused my family, friends and co-workers on 24 and at 20th Century Fox," Sutherland said in a statement. "I appreciate the support and concern that has been extended to me these last weeks both personally and professionally." The 40-year-old 24 star was arrested on September 25 after he was pulled over for making an illegal U-turn in Hollywood. A statement released by 20th Century Fox indicated that Sutherland's jail term would not affect production on 24. "Kiefer made it clear to us at the time of his arrest that his first concern was the welfare of those he worked with and that he intended to do whatever was necessary to prevent shutting down the show because of his situation," said the statement. "He told us that even if he had to sacrifice more time in custody in order to protect the show and the jobs of those who work with him, he would do so. From what occurred today, it is evident he is a man of his word. We wish him well and look forward to a long relationship with him."

Another celeb could face jail time

Michelle Rodriguez has failed to fulfill the terms of her probation in a DUI case and may face jail time, the LA City Attorney's office announced yesterday. "She hasn't shown proof of completion of her 30 days of community service," said a city spokesperson. "She could face jail time, but it's up to the judge." The City Attorney's office alleges that Rodriguez turned in a false document showing that she'd completed one day of service on September 25, court filings show. However, the actress later stated that she was in New York on that date. On Friday afternoon, Rodriguez arrived at the court for a hearing on the matter, looking somber and accompanied by her lawyer, who successfully asked the judge to postpone Friday's hearing to Oct. 12. Rodriguez was scolded by the Superior Court judge, who ordered her to complete two days of road cleanup duty for the California Department of Transportation. Outside the court, the Lost alum's attorney said, "We believe this is all due to a clerical error. My client did complete the full 30 days." In May 2006, Rodriguez served only four hours and 20 minutes of a two month sentence at the Lynwood, California, jail for violating probation stemming from a DUI arrest in Hawaii.
